Small Claims Court Depends on Amount, Place, and Court Type

A small claim asks for money. It cannot be used to make someone perform a promise or repair something. The court and dollar limit depend on where the defendant is tied to the case.

Outside New York City, Nassau County, and western Suffolk County, the limit is $5,000 in City Court or $3,000 in Town or Village Court. New York City Small Claims Court has a $10,000 limit. Nassau County and western Suffolk County use District Court for claims up to $5,000. An individual can bring a small claim; corporations, partnerships, and associations use the commercial-small-claims route.

For example, an individual seeking $4,200 from a Buffalo business may fit City Court, but that amount is over a Town or Village Court’s limit. A $7,500 money claim may fit New York City Small Claims Court if the venue rules also point there.

Start with the defendant’s exact legal name and street address. Then use the New York Courts locator to match the amount, location, and court type. In general, the defendant must live, work, or have a business connection in the place where the claim is filed, but the exact venue rule changes with the court. Keep the contract, receipt, notices, photos, and a short calculation of the amount with the filing papers.
